By accessing our website, placing an order, purchasing a product, uploading content, or using our Services, you agree to these Terms.

If you do not agree with these Terms, please do not use our website or purchase our Services.

1. Our Services

ToppersLife provides digital creative products and services, which may include:

Birthday and anniversary invitations

2. Digital Products

Unless specifically stated otherwise, products sold through ToppersLife.com are digital products.

No physical product will be shipped when a product is identified as a digital product.

Customers are responsible for reviewing the product description before purchasing to understand what is included.

3. Custom-Made Products

Many ToppersLife products are customized specifically for each customer.

Customers may be asked to provide information such as:

Photos

Production may not begin until all required information has been received.

4. Customer Responsibility for Information

You are responsible for ensuring that all information submitted to ToppersLife is accurate.

Please carefully review names, spelling, dates, times, addresses, telephone numbers, event information, and other personalization details before submitting them.

ToppersLife is not responsible for errors resulting from incorrect information supplied by the customer.

If you notice an error after submitting your order, contact us as soon as possible. We will make reasonable efforts to correct the information if production has not been completed.

5. Photos, Videos, Logos and Other Customer Content

When you upload or submit photographs, videos, logos, music, graphics, text, or other materials (“Customer Content”), you represent that you own the content or have the necessary rights, licenses, consents, and permissions to provide it to ToppersLife and authorize its use for your order.

You grant ToppersLife a limited permission to use, reproduce, edit, crop, resize, animate, format, modify, combine, and otherwise process Customer Content as reasonably necessary to create and deliver your purchased product or service.

You retain ownership of your original Customer Content.

ToppersLife does not claim ownership of your personal photographs, videos, logos, or other original materials merely because you submitted them for an order.

6. Content Involving Other People

If Customer Content contains another person's name, photograph, video, likeness, voice, logo, intellectual property, or other personal information, you are responsible for obtaining any permission required to use and submit that content.

This includes content involving children or minors.

By submitting such content, you represent that you have the authority or appropriate permission to use it for the requested product or service.

7. Prohibited Content

You may not use ToppersLife to create, upload, transmit, or distribute content that is unlawful or that infringes another person's intellectual property, privacy, publicity, or other legal rights.

ToppersLife reserves the right to refuse or cancel an order involving content that we reasonably believe violates these Terms or applicable law.

8. Production and Delivery Times

Estimated production and delivery times may be displayed on individual product pages.

For products advertised with a specific turnaround time, such as 24-hour customization, the turnaround generally begins after we have received all information, files, photos, videos, and other materials necessary to complete the order.

Turnaround times are estimates unless we expressly guarantee a deadline in writing.

Delays caused by missing information, customer-requested changes, technical issues outside our reasonable control, or delayed customer responses may extend the delivery time.

9. Revisions

The number of revisions included with a purchase, if any, may be stated in the product description.

A revision generally means a reasonable modification to the original product, such as:

Correcting information
Changing text
Making minor color adjustments
Replacing an image
Making reasonable design adjustments

A revision does not generally include creating an entirely new product, selecting a completely different template after customization has been completed, or substantially changing the original concept.

Major changes or additional revisions may require an additional fee.

10. Customer Approval

For certain custom projects, ToppersLife may provide a preview or proof for customer review.

It is the customer's responsibility to carefully review the proof for spelling, names, dates, addresses, photos, and other details.

Once a customer approves a final design, additional changes may be subject to additional fees.

11. Prices and Payments

Prices are displayed on ToppersLife.com and may change without notice.

The price applicable to your purchase will generally be the price displayed when your order is placed, subject to correction of obvious pricing or technical errors.

Payment is required according to the terms displayed during checkout.

Applicable taxes may be added when required by law.

12. Cancellations and Refunds

Because many ToppersLife products are digital, customized, or personalized, all sales are generally final once production has begun or a digital product has been delivered or made available for download.

Orders may be eligible for cancellation if the customer contacts us before customization or production begins.

Refunds, cancellations, duplicate charges, errors, and related matters are governed by our Refund & Cancellation Policy, which forms part of these Terms.

Nothing in these Terms limits any non-waivable rights or remedies available to consumers under applicable law.

13. Digital Downloads

Customers are responsible for downloading and safely storing purchased digital files.

A digital product may be delivered through email, download link, customer account, or another electronic method.

ToppersLife does not guarantee that download links will remain available indefinitely.

We recommend downloading and securely saving your completed files promptly after delivery.

14. Personal Use and Commercial Use

Unless otherwise stated in the product description or a separate license, digital templates and creative products purchased from ToppersLife are licensed for the purchaser's personal or authorized business use.

Purchasing a product does not automatically transfer ownership of ToppersLife's underlying templates, designs, design systems, source files, or other intellectual property.

15. No Resale or Redistribution

Unless ToppersLife expressly provides written permission or a commercial/resale license, you may not:

Resell our templates
Redistribute our digital files
Share purchased templates for others to use
Upload our products to another marketplace for resale
Claim our original designs as your own
Copy or reproduce our products for commercial resale
Sell modified versions of our templates as templates
Provide purchased files to others for unauthorized commercial use

Purchasing a digital product gives you only the usage rights specifically associated with that product.

16. ToppersLife Intellectual Property

The ToppersLife name, branding, website content, graphics, original designs, templates, animations, videos, product images, text, and other original materials are owned by or licensed to ToppersLife and are protected by applicable intellectual property laws.

Except for the rights specifically granted with your purchase, no ownership rights are transferred to you.

17. Use of Custom Work in Our Portfolio

We respect the privacy of customer-submitted photographs and videos.

ToppersLife will not intentionally publish private customer photographs or videos in our public portfolio, advertisements, or social media solely because they were submitted for an order.

We may request separate permission from you if we would like to feature your completed custom project for promotional purposes.

18. Third-Party Platforms and Services

ToppersLife may use third-party platforms and technologies to operate our website, process payments, create digital products, communicate with customers, store files, deliver downloads, or provide other Services.

These may include e-commerce platforms, payment processors, cloud services, design software, video editing software, artificial intelligence tools, email providers, and social media platforms.

ToppersLife is not responsible for interruptions, outages, changes, or failures caused by third-party services outside our reasonable control.

19. AI-Assisted Creative Tools

ToppersLife may use digital editing, automation, artificial intelligence, or other creative technologies as part of the design and production process.

These technologies may be used for tasks such as creating design elements, improving images, producing visual effects, generating backgrounds, editing videos, creating animations, or assisting with other creative work.

By purchasing custom creative services, you acknowledge that such technologies may be incorporated into our production workflow where appropriate.

20. Color and Display Differences

Colors, brightness, resolution, animation quality, audio, and other visual characteristics may appear differently depending on the customer's phone, computer, monitor, browser, application, social media platform, or other device.

Minor differences in appearance caused by different devices or platforms are not considered defects.

21. Social Media Content

When ToppersLife creates reels, shorts, advertisements, promotional graphics, or other social media content, we do not guarantee specific numbers of:

Views
Followers
Likes
Comments
Shares
Leads
Sales
Engagement
Revenue

Performance depends on numerous factors outside our control, including platform algorithms, audience behavior, advertising budgets, competition, timing, and market conditions.

22. Website Availability

We attempt to keep ToppersLife.com available and operating properly, but we do not guarantee uninterrupted or error-free access.

We may temporarily suspend or modify portions of the website for maintenance, security, updates, or other operational reasons.

23. Limitation of Liability

To the maximum extent permitted by applicable law, ToppersLife will not be liable for indirect, incidental, special, consequential, or similar damages arising from the use or inability to use our website, products, or Services.

To the extent permitted by law, ToppersLife's total liability relating to a particular order will not exceed the amount actually paid to ToppersLife for that order.
